Terms of Use

1. The provider and the service

The bizcup.app platform (the “Platform”) is operated by Pro-Sharp Hungary Zrt. (registered seat: 1145 Budapest, Bácskai utca 29/A, Hungary; company reg. no.: 01-10-143757; tax no.: 33095424-2-42; EU VAT no.: HU33095424; e-mail: bizcup@pro-sharp.hu; the “Provider”). The Platform is a free corporate football prediction contest. These Terms govern use of the Platform; the contest is governed by the Game Rules and data processing by the Privacy Policy.

2. Relationship of the parties

Two types of user use the Platform: the Company launching the contest within its organisation (B2B client) and the player (the company’s employee, an invited participant, or a user registering independently). These Terms apply to players and general use of the Platform. A Company that creates a league is also subject to the B2B/subscription terms and Data Processing Terms (DPA) published on the Platform, which the Company accepts by using the Platform (creating or administering a league); the DPA is available at www.bizcup.app/legal/dpa. Concluding a separately hand-signed contract is not a precondition for using the service.

3. Fees

Use of the Platform is free for the player: no stake, entry fee or other payment. The Platform is free for up to 25 players per company; above that number a paid company plan (B2B subscription) may be required. One company runs one league, and headcount and other limits apply at the company level. Any fee is always paid by the Company for the software, never by the player for participation; the player’s participation remains free regardless of headcount. This fee is not a stake and is not linked to any prize.

4. Account and login

Login is via company e-mail (magic link), corporate SSO (Google Workspace / Microsoft 365) or e-mail + password registration. The user is responsible for keeping their account credentials confidential and for activity on their account. Users must provide accurate data and act only in their own name.

A user who creates or administers a league (admin) warrants that they are entitled to represent the relevant company and/or control its domain. The Provider may verify company and domain control (e.g. company e-mail, SSO tenant, or DNS or file-based proof) and may suspend, reassign or delete a league in case of false, misleading or impersonating claims.

5. Acceptable use

The user may use the Platform only as intended and lawfully. It is prohibited, in particular, to:

• use the Platform for betting, collecting stakes, creating a prize pool, transferring money between players, or any competition tied to a stake in money or property value — whether organised on or off the Platform using its results;

• disrupt the Platform’s operation, perform automated data collection (scraping), attempt to breach security, use multiple accounts or manipulation;

• upload unlawful, offensive, misleading or third-party-infringing content (e.g. team name, nickname);

• copy, distribute or resell the Platform or its parts without authorisation.

The Provider may warn an infringing user, remove content, and suspend or delete the account or league.

6. User content

The user is responsible for content they provide (e.g. team name, nickname, shared card). The user grants the Provider a non-exclusive, royalty-free licence to display such content for operating the Platform. The Provider may remove manifestly unlawful content.

7. Intermediary liability and notice

The Provider acts as an intermediary/hosting provider for user-generated content (predictions, nicknames, messages). Under applicable EU and Hungarian rules (the Digital Services Act and the e-commerce act), the Provider is not liable for users’ unlawful activity provided it has no actual knowledge thereof, does not facilitate it, and acts without delay upon becoming aware.

Anyone may report unlawful content or prohibited use under Section 5 to bizcup@pro-sharp.hu. The Provider acknowledges receipt, investigates without undue delay, removes content or suspends access where justified, and informs the affected parties of its decision with reasons. The affected party may appeal at bizcup@pro-sharp.hu.

8. Intellectual property

The “BizCup” name, branding, the Platform software and its look-and-feel are the intellectual property of the Provider or its licensors. If a Company provides its name or logo to identify its league, it remains the Company’s property and the Provider uses it solely to display that league. The Platform is not affiliated with FIFA and uses no official tournament trademarks.

9. Availability, limitation of liability

Use of the Platform is free for the player. The Provider supplies the Platform on an “as is” and “as available” basis, with due care, but does not guarantee uninterrupted or error-free operation, and may carry out maintenance, development or suspend the service.

To the fullest extent permitted by law, the Provider excludes all liability for damages arising from use or unavailability of the Platform, any error in predictions, results or points, data loss, or any cause beyond its control (network, device, third-party data provider, force majeure, third parties) — including direct and indirect damage and lost profit. The user uses the Platform at their own risk.

Under Hungarian law, liability cannot be excluded for breaches caused intentionally or by gross negligence, or causing harm to life, bodily integrity or health, nor can mandatory consumer rights be limited; this section does not affect those.

10. Termination

The user may delete their account at any time. The Provider may discontinue the service or individual leagues with prior notice, and may restrict or terminate the access of a user breaching these Terms.

11. Amendment, governing law

The Provider may amend these Terms unilaterally; the current version is on the Platform, with notice of material changes. These Terms are governed by Hungarian law; in a consumer dispute the player may turn to the conciliation board of their place of residence.
